In this article, I explore the witness of Mary Magdalene for its potential to contribute to discussions of survival and healing taking place in discourses of trauma. Through a reading of the Johannine text and an examination of Hans Urs von Balthasar’s depiction of Mary’s witness in Heart of the World, I claim that the obstructions of Mary’s witness are constitutive of what it means to witness between cross and resurrection. Through her ‘unseeing’, she testifies to the unique configuration (...) of divine love between death and life. Mary’s witness not only provides an entrance into thinking about the experience of ‘middleness’ in trauma, it opens up a rich pneumatology in the wake of the cross. (shrink)

Praised as a panacea for resolving all societal issues, and self-evidently presupposed as technological innovation, the concept of innovation has become the emblem of our age. This is especially reflected in the context of the European Union, where it is considered to play a central role in both strengthening the economy and confronting the current environmental crisis. The pressing question is how technological innovation can be steered into the right direction. To this end, recent frameworks of Responsible Innovation focus on (...) how to enable outcomes of innovation processes to become societally desirable and ethically acceptable. However, questions with regard to the technological nature of these innovation processes are rarely raised. For this reason, this paper raises the following research question: To what extent is RI possible in the current age, where the concept of innovation is predominantly presupposed as technological innovation? On the one hand, we depart from a post-phenomenological perspective to evaluate the possibility of RI in relation to the particular technological innovations discussed in the RI literature. On the other hand, we emphasize the central role innovation plays in the current age, and suggest that the presupposed concept of innovation projects a techno-economic paradigm. In doing so, we ultimately argue that in the attempt to steer innovation, frameworks of RI are in fact steered by the techno-economic paradigm inherent in the presupposed concept of innovation. Finally, we account for what implications this has for the societal purpose of RI. (shrink)

These then are the four main strands in Aristotle's thought concerning the law, or in other words, the four elements he might have distinguished in his conception of law. The analysis I have attempted seems to me to reflect both Aristotle's view of the complex nature of law and also what he would look upon as the different grounds for its validity. I think that the several elements in his doctrine are fundamentally independent of one another, and similarly that they (...) do not compete with one another since they embody answers to different questions concerning law. Also the recurrent theme of my own comments has been the assumption that 'law' is a complex term, comprising in its application a number of different definitions concerning rules and validity, authority and obligation, sources of law, and the like. In my opinion it is the merit of Aristotle's conception of law that he appears to recognise the multiple meaning of the word ‘law’ and, accordingly, the need for a multiple definition. (shrink)

On the basis of Karl-Otto Apels’ diagnosis of the shortcomings of philosophical ethics in general, and any ethics of individual accountability in particular, I give an outline how these shortcoming are currently to be articulated in the context of ecological crisis and socio-technical change. This will be followed with three interpretations of Karl-Otto Apels’ proposal for an ethics of collective coresponsibility. In conclusion, I will advocate that only a further social evolution of the systems of science, economy and law will (...) enable a possible institutionalization of collective co-responsibility by means of a new innovation paradigm: responsible innovation. Open science will make science more efficient, reliable, and responsive to societal challenges. The European Commission has sought to advance open science policy from its inception in a holistic and integrated way, covering all aspects of the research cycle from scientific discovery and review to sharing knowledge, publishing, and outreach. We present the steps taken with a forward-looking perspective on the challenges laying ahead, in particular the necessary change of the rewards and incentives system for researchers (for which various actors (...) are co-responsible and which goes beyond the mandate of the European Commission). Contemporary theories of criminalisation address, with varying emphasis, themes concerning the harmfulness and the wrongfulness of the conduct. In his article for the present issue, Antony Duff relies chiefly on notions of wrongfulness as the basis for his proposed criminalisation doctrines; whereas in their 2011 volume on criminalisation, Andrew Simester and Andreas von Hirsch invoke both wrongfulness and harmfulness as prerequisites for prohibiting conduct. The present article assesses the comparative merits of these approaches, and argues in favour of the latter, (...) two-element perspective. In this article, the author puts forward a number of reasons suggesting why the two-element approach is preferable. These reasons include, firstly, an inductive argument—that the kinds of wrongful conduct for which criminalisation seems a plausible response are those that include an element of harm or risk of harm. Secondly, a defining role for the state is one of resource-protection: of safeguarding the means and resources through which citizens can live good lives. Thus the concept of citizens’ living resources—and the related conception of harm—should be made a constitutive and explicit element of criminalisation theory, rather than subsuming resource-protection under a general rubric of wrongfulness. Thirdly, a two-element approach provides reciprocal limiting principles concerning the scope of criminalisation. One can, for example, employ wrongfulness requirements to limit the criminalisation of conduct that has remote harmful consequences; and, conversely, use a harmfulness requirement as means for restricting the criminalisation of wrongful acts. Problem: How can constructivists speak of social interaction or communication with others, when, as they claim, their experiential world is their own construction? This question is frequently asked and is perfectly reasonable. The present paper is intended as an answer. Solution: After providing an outline of the constructivist approach to perception and the generation of recognizable objects in the experiential field, I argue that “others,” too, can be explained as an individual’s creation; a creation, however, that is just as constrained (...) by the condition of viability as are the physical objects with which we furnish our world. Consequently, “society” too can be considered an individual construct rather than an ontological given. Benefits: The exposition may help to clarify the constructivist position with regard to social interaction and communication. (shrink)

Strudler rejects shareholder primacy and argues that, once contractual obligations have been fulfilled and shareholders have received a reasonable return on investment, corporate executives may use corporate wealth for the general good. He seeks to establish this claim via an argument that, contrary to the received view, shareholders do not own corporations. After raising some questions about the latter argument, this commentary goes on to argue that the question of corporate ownership is a red herring. The argument for shareholder primacy (...) that Strudler wants to reject does not rely on the premise that shareholders own the firm. (shrink)

Excerpt: I feel that the use of terms such as “code,” “information,” and “symbol” for neural constellations that are not further described defeats the intention of the analysis presented because unless these terms are explicitly given specific neurobiological definitions they inevitably suggest the presence of a consciously reflecting agent.

A close examination of the relationship between media, art, and the "Electra complex" The feminist counterpart to Deleuze and Guattari's Anti-Oedipus, Anti-Electra is a philosophy of "the girl" as a model of contemporary transgressive subjectivity. Elisabeth von Samsonow asserts that focusing on the girl's escape from the Oedipus complex leads to a fundamental shift in our most common views on media and art. Presenting an interpretation of contemporary technics, Anti-Electra argues that technology today encompasses Electra's gadgets and toys. According to (...) von Samsonow, satellite drive technologies such as wireless telephones, WLAN, and GPS echo the "preoedipal constellation" that the girl specializes in. And with the help of the girl, the cartography of overlapping zones between humankind and animals, as well as between humankind and apparatuses, is redesigned through what the book holds as a "radical totemism." Anti-Electra ultimately offers a new view on gender, the contemporary world dyed by symbolic girlism, and the (universal) girl in critical dialogue with media, ecology, and society. (shrink)

1807 konstatiert Hegels "Phänomenologie des Geistes" das Ende der Geschichte. 200 Jahre später scheint es Zeit für eine Bilanz: Wie verhält sich eine von technologischen und medialen Zwängen geprägte Demokratie zu dem von Hegel avisierten System der Freiheit? Als eine Geschichte der vollendeten Geschichte geht dies Buch einer Dialektik der Freiheit nach, die in der Nachfolge der Französischen Revolution im Namen von Gleichheit und Brüderlichkeit Totalität beansprucht. In der Durchsetzung dieses Anspruchs werden Wesenszüge der totalitären Systeme, der Technikfetischismus des Kommunismus (...) und die Propaganda des Faschismus, als Teil einer Entwicklung verständlich, an deren Ende die Logik des Sachzwangs und das Diktat medialer Öffentlichkeit stehen. Sollte sich Freiheit somit gerade dort vollenden, wo - jenseits der Geschichte - mehr denn je passiert, ohne dass sich noch Wesentliches ereignet? (shrink)
